DMCA Policy

Elevate Realty Group is committed to respecting the intellectual property rights of others. We expect our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to notices of alleged infringement that comply with the DMCA and other applicable laws.
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on this site, please notify our Designated Copyright Agent as set forth below. For your notice to be effective, it must include the following information:
  1. Identification of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by this notice, you may provide a representative list of the copyrighted works that you claim have been infringed.
  2. Identification of the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Please provide a URL to the material that you claim is infringing.
  3. Your contact information, including your address, telephone number, and an email address.
  4. A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
  6. Your physical or electronic signature.

Upon receipt of a valid notice, we will respond by either removing the allegedly infringing material or disabling access to it. We will also take reasonable steps to notify the user who posted the material of the removal or disabling of access.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.
If you believe that your material has been removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent with the following details:
  1. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  2. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or if you are outside the United States, the district in which your service provider is located), and that you will accept service of process from the person who provided the original notification or an agent of such person.
  4. Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will promptly provide the person who filed the original notification with a copy of the counter-notification and inform that person that we may replace the removed material or cease disabling access to it in 10 business days. Unless the copyright owner files an action seeking a court order against the provider of the material or the user, we will replace the removed material or cease disabling access to it in 10 to 14 business days after receipt of the counter-notification.
